Privacy Policy

Effective Date: April 30, 2025

Introduction

The Bangers App Inc ("we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how our application, The Bangers App (the "App"), collects, uses, and safeguards your information when you connect your TikTok account and use our services. The App allows you to link your TikTok account to access your own public video library, retrieve engagement metrics, and repost your content across other platforms in a manner consistent with TikTok's policies and applicable U.S. privacy laws.

We only use data that you provide through TikTok's official API with your authorization. We do not collect any data by scraping or from unofficial third-party sources. By using the App or connecting your TikTok account, you agree to the collection and use of your information as described in this Privacy Policy. We adhere to TikTok's Platform Terms and Data API requirements, which emphasize that your data belongs to you and should not be shared without proper consent. Our practices are designed to give you control over your data and to comply with all relevant laws and regulations.

Information Collected

We collect personal information and data only to provide and improve our services to you. This includes:

Data from Your TikTok Account

When you connect your TikTok account, we receive information through TikTok's API that you authorize us to access. This may include your TikTok username and basic profile details, a list of your public TikTok videos (e.g., titles or captions, video identifiers), and engagement metrics for those videos (such as view counts, likes, comments, or shares). If the App's functionality allows, we might also access content necessary for reposting (for example, your video files or links) strictly to enable you to share your own content on other platforms. Importantly, we do not access any TikTok data that you do not explicitly permit via the TikTok login and authorization process, and we do not collect information about other users or content on TikTok beyond your own profile and content.

User-Provided Information

If you create an account with us (or through TikTok Login), we may collect any information you provide during registration or profile setup. This could include a display name or contact email (if you choose to provide one). Additionally, if you contact us for support or communicate with us by email, we will collect your name, email address, and the content of your correspondence in order to assist you.

App Usage Data

We may automatically collect certain technical information when you use the App. This can include device information (e.g., device type, operating system, app version), log information (dates/times of access, pages or features used), and other usage analytics. We gather this data to understand how the App is performing and how users interact with it, which helps us improve functionality and user experience. This information is generally collected in aggregate form and does not directly identify you; we do not collect precise location data or any sensitive personal information.

Note: The App does not collect any personal information beyond what is described above. We do not obtain data from outside the TikTok API or your direct interactions. In particular, we do not collect any sensitive personal data (such as financial information, health information, or biometric identifiers), and we do not knowingly collect any information about your followers or other TikTok users. Our data collection is limited to what is necessary for the App's stated purposes and what you have consented to through TikTok's permissions.

How Information Is Used

We use the collected information solely for legitimate purposes related to providing and improving our services. Specifically, we may use your information in the following ways:

Providing App Features

To operate the App and deliver its core functionalities to you. For example, we use your TikTok data to populate your in-app content library, display your video engagement metrics, and enable tools like content filtering and analytics dashboards. When you choose to repost content, we use the data (e.g., your video and caption) to facilitate sharing that content to the platforms you select, at your direction. All of these uses are strictly to enhance and personalize your experience with the App's content management and productivity tools.

Improving and Personalizing the Service

To analyze usage and performance of the App in order to make improvements, fix bugs, and develop new features. For instance, we might review aggregated engagement data or user feedback to refine our analytics and reposting tools. Any analytics we perform on your data are internal and for the benefit of the user experience. Data collected is used solely for internal analysis and performance enhancements – we do not use your content or metrics for any form of advertising profiling or to benefit third parties.

Customer Support and Communications

To provide you with support and respond to your inquiries. If you reach out to us at our support email, we will use your contact information to communicate with you and resolve issues. We may also send you service-related notifications or important updates about the App (for example, changes in features, or updates to this Privacy Policy or our Terms of Service). We will not send you marketing or promotional emails unrelated to the App unless you have expressly opted in to such communications.

Security and Fraud Prevention

To monitor, investigate, and prevent any fraudulent, unauthorized, or illegal activity on the App. We may use technical information (like device identifiers or IP addresses) and usage logs to help detect security issues and protect against malicious activity. This use helps us keep the App safe and secure for all users.

Legal Compliance

To comply with any applicable legal obligations. For example, if we are required by law to retain certain data or to provide information in response to lawful requests (such as court orders), we will use and handle the minimum necessary data for that purpose. (See "Sharing and Disclosure" below for more on how we handle legally required disclosures.)

We will only use your information for the purposes above and will not use personal data in any manner that is incompatible with these purposes. In particular, we do not use or share your TikTok-derived information for any independent commercial purpose outside of providing our service to you. Our usage of your data is fully in line with the permissions you grant and TikTok's expectations for authorized apps. In short, your data is used to serve you, not us or anyone else.

Data Storage and Security

We take data security seriously and employ measures to protect your information. All user data obtained by the App is stored securely on Amazon Web Services ("AWS") cloud servers. AWS is a reputable cloud infrastructure known for its robust security practices and compliance with industry standards. By using AWS, we benefit from strong physical and network security for our databases.

In addition, we implement our own safeguards, including:

Encryption

We transmit all sensitive data (such as your access tokens and personal information) over secure HTTPS connections. This means data is encrypted in transit between your device, TikTok, and our servers. We also encrypt data at rest in our databases wherever feasible, adding an extra layer of protection in case of unauthorized access.

Access Controls

We restrict access to personal data to authorized personnel who need it to operate or support the service. Our team members are trained on the importance of privacy and are bound by confidentiality obligations. Administrative access to systems storing user data is limited and protected by strong authentication.

Security Monitoring

We monitor our systems for possible vulnerabilities and attacks. We use industry-standard security tools and practices (such as firewalls, routine security audits, and regular software updates) to protect against unauthorized system access and data exfiltration.

While we strive to protect your information and follow industry best practices, please note that no method of transmission over the internet or electronic storage is 100% secure. Thus, although we work hard to safeguard your data, we cannot guarantee absolute security of information at all times. You can help protect your account by keeping your TikTok login credentials secure and by disconnecting the App if you suspect any unauthorized access. If we ever become aware of a data breach that affects your personal information, we will notify you and take appropriate steps in accordance with applicable laws.

User Rights and Controls

You have important rights and choices regarding your personal information. We believe in transparency and giving users control over their data. Below are the ways you can manage your information and exercise your rights:

Access and Portability

You have the right to request a copy of the personal data we hold about you. This includes the information you provided and data collected from TikTok on your behalf. We can provide this in a readily usable format. Given that much of the data is your own TikTok content and metrics, you may already have access to it via TikTok, but we will assist in providing any additional data (like logs or account info) that we maintain.

Correction

If you believe that any information we have is inaccurate or incomplete, you have the right to request that we correct it. In practice, most of your data (such as TikTok profile info or video data) can be updated by making changes in your TikTok account, which will then flow through to our App via the API. For any account information you provided directly to us (if applicable), you can update it within the App settings or by contacting us.

Revoking TikTok Access

You may disconnect your TikTok account from our App at any time. This can typically be done via the App's settings or via your TikTok account's settings (under the list of connected apps). Revoking the App's access will stop our ability to collect any further data from your TikTok account. We will honor such a disconnection by deleting or anonymizing any residual personal data from TikTok that we no longer need to provide the service to you.

Deletion (Right to Erasure)

You have the right to request that we delete your personal data. If you no longer want us to have your information, you can contact us to request deletion. Once we verify your identity and your request, we will promptly delete the personal information we have about you from our active systems. Do note that we may retain certain minimal information as required for legal compliance or legitimate business purposes (e.g., records of a transaction or communications, or data stored in routine backups) – but if so, we will ensure any retained data is protected and used only for those necessary purposes.

California Privacy Rights

If you are a California resident, you are entitled to specific rights under the California Consumer Privacy Act ("CCPA") and its amendments. These include the right to know what categories of personal information we collect, the right to access your information, and the right to request deletion of your information. You also have the right to opt out of the "sale" or sharing of your personal information. However, we do not sell your personal information to any third parties (see "Sharing and Disclosure" below), so this right is generally not applicable except that we affirm we do not sell data. We also will not discriminate against you for exercising any of your privacy rights. (California residents may also have rights to request certain disclosures about our data-sharing with third parties for direct marketing; however, we do not share personal data for direct marketing purposes without consent.)

Opt-Out of Communications

As noted, we will not send you marketing communications without consent. If you have opted in and later change your mind, you can opt out of receiving such emails by using the unsubscribe link in those emails or by contacting us. Note that you cannot opt out of essential service-related communications (like an email notifying you of a significant policy update or a customer support response) as these are considered part of the service.

To exercise any of your rights or controls above, please contact us at our support email (see Contact Information below). We will respond to your request as soon as possible, and in any case within any timeframes required by law. For security, we may need to verify your identity (for example, by confirming details of your account or recent activity) before fulfilling certain requests like access or deletion. If you have authorized an agent to make a request on your behalf, we will require proof of that authorization as well.

Data Retention

We will retain your personal information only for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. In general, this means:

If you have an active account or connected TikTok profile with the App, we will keep your information for as long as your account is active and you are using the App. We retain your data to provide you with the service – for example, to continually show your content and analytics, and to support your reposting and content management needs. It is in our legitimate interest and yours that we have the data available to operate the App for you.

If you choose to disconnect your TikTok account, stop using the App, or request deletion of your data, we will delete or anonymize the personal data we have about you (as described under User Rights and Controls). Typically, when a user fully disconnects and does not intend to return, we will remove their TikTok-sourced data from our systems. We may retain non-personal information (aggregated analytics that do not identify you) for internal analysis even after deletion of personal data, but this will not contain anything that could identify an individual user.

In certain cases, we may retain specific information for legal or compliance reasons even after an account is deleted or inactive. For example, we might keep records of financial transactions (if any payments were involved) for accounting and tax purposes, or retain information as necessary to comply with law enforcement requests or to resolve disputes. However, such retention will be limited to what is strictly necessary and for the period required by the relevant law or purpose. After that period, the data will be deleted or anonymized.

In summary, we retain your information for as long as your account is active or as needed to provide you services, and thereafter only as required for legal, security, or business obligations. When we no longer have a legitimate need to keep your personal data, we will dispose of it in a secure manner.

Sharing and Disclosure

We value your privacy, and one of our core principles is that we do not share your personal data with third parties except in very limited circumstances. Under no circumstances do we sell or rent your personal information to third parties for their own use. We also do not disclose your data to others for marketing or advertising purposes. The data you provide and that we collect is used for your benefit as described above, and we keep it confidential. That said, there are some situations where we may share or disclose your information, strictly for the reasons outlined below and with appropriate safeguards:

Service Providers (Processors)

We may share your information with trusted third-party companies that perform services on our behalf and help us operate the App. This includes, for example, our cloud hosting provider (Amazon Web Services) where your data is stored, and could include other ancillary service providers such as database management, analytics services, or email service (for sending support responses). These service providers are given access only to the information necessary to perform their functions and are contractually obligated to protect your data and use it solely for providing services to us. They are not permitted to use your information for any other purpose. We take steps to ensure any third party handling your data maintains at least the same level of privacy protection that we do.

Legal Compliance and Protection

We may disclose your information if we are required to do so by law or if such action is reasonably necessary to comply with legal processes. For example, we might share data in response to a lawful subpoena, court order, or government request. We may also disclose information when we believe in good faith that it is necessary to protect the rights, property, or safety of our company, our users, or the public. This includes exchanging information with other entities for fraud prevention or security protection. Any disclosure for legal or safety reasons will be narrowly tailored to fulfill the specific obligation or risk.

Business Transfers

If The Bangers App Inc is involved in a merger, acquisition, investment, reorganization, or sale of all or a portion of its assets, your information may be transferred to the acquiring or successor entity as part of that transaction. We will ensure that any such entity is bound by privacy obligations compatible with those in this policy, and we will provide notice on our website or within the App if a transfer of personal data occurs, along with any choices you may have. Similarly, if we ever undergo bankruptcy or another change in corporate control, personal information could be considered an asset and transferred, but this Privacy Policy would continue to apply to your data (unless you're notified of changes).

With Your Consent

In any other scenario not covered above, we would only share your information if you directly consent or instruct us to do so. For instance, if in the future our App integrates with another platform and you explicitly request or consent to transferring your data to that platform, we will do so only with your permission. We will always make it clear and obtain your approval before sharing your personal data in any new way.

We reiterate that we do not sell your personal information and we do not disclose your data except as necessary to run the service or as required by law. When we do share data with the limited third parties above, we remain responsible for its protection. We review our third-party partners for strong security practices and only work with those who meet our standards for data protection. If you have questions about third parties that may have access to your data, you can contact us for more information.

Children's Privacy

Our App is not intended for use by children under the age of 13. We do not knowingly collect or solicit any personal information from children under 13 years old. Users must be at least 13 years old to create a TikTok account, and since our App relies on connecting a TikTok account, it is inherently not available to younger children. We do not target our services at children, and we do not knowingly process any personal data from anyone under 13. If you are under 13, please do not use the App or provide any information about yourself to us.

In the event we learn that we have inadvertently collected personal information from a child under 13, we will take immediate steps to delete such information from our records. If you are a parent or guardian and you become aware that your child has provided personal data to us without your consent, please contact us at our support email so we can promptly remove the data and terminate the child's account, if applicable.

For minors aged 13 to 17, we recommend using the App only with parental or guardian guidance. Although our features are not inappropriate for these ages, it's important that young users understand the importance of privacy and have parental support in making decisions about linking social media accounts. If you are a minor in this age range, by using the App you affirm that you have obtained parental consent to do so, where required by law.

Changes to This Policy

We may update or revise this Privacy Policy from time to time. If we make any material changes, we will let you know by updating the "Effective Date" at the top of the policy and, if appropriate, by providing a notice within the App or via email. Any changes will be effective immediately upon posting of the revised Privacy Policy to the App or our website, unless stated otherwise.

We encourage you to review this page periodically to stay informed about our privacy practices. In the event of significant changes to how we collect or use your personal information, we will take additional steps to notify you (for example, by emailing you or presenting a pop-up notice in the App) and, if required by law, to obtain your consent. Your continued use of the App after any changes to this Privacy Policy signifies your acceptance of the revised terms. If you do not agree with the changes, you should disconnect your TikTok account and discontinue use of the App before the updated policy takes effect.
